Personal Data Processing Acknowledgment and Consent Agreement

As an applicant for acceptance and enrollment at NC State University (“NC State”), I acknowledge, understand, and agree to the following:

I will be asked to provide personal and sensitive data (personal and sensitive data may be referenced collectively in this Agreement as the “data”) in order to evaluate and process my admissions application, and for my registration and participation in educational programs and activities attendant to my potential enrollment at NC State – this may include online education, academic and administrative support services, outreach and marketing, and other services offered by NC State. I may be asked on an ongoing basis to provide additional data to fulfill these services or for participation in University programs. In addition, NC State may collect or has collected data from other sources in order to process my application and enable participation educational activities and receive educational services. These additional sources include, third-party application services, such as Apply Yourself and Slate, standardized testing databases, such as GRE, TOEFL, GMAT, IELTS, etc., and third-party background check service providers. This data, which may include health information, race, and national origin, will be used by NC State to deliver program and educational services, provide academic, administrative, and wellness support services, give support in the event of a health or safety emergency, and allow NC State to meet local, state and federal obligations.

The data will be processed for legitimate educational purposes and in accordance with applicable laws and NC State policies, regulations, and rules. The data will be maintained in compliance with the NC State Records Retention and Disposition Schedule.

I understand that the data will be collected and processed both manually and automatically by NC State and is necessary to achieve the following purposes:

  1. To execute contractual obligations;
  2. To comply with applicable law; and
  3. To protect the health and safety of myself or others.

I understand that NC State contracts with third parties who may have access to my data. NC State will only share data with third parties who have a legitimate educational interest in receiving the data. The data will not be released to any other third party except as required or authorized by law. In addition, the data may be transferred to and from the United States and the country I reside, or will reside, in order fulfill the aforementioned obligations.

NC State ensures that proper administrative and technical measures, and necessary safeguards, are implemented to secure all data processed and maintained by NC State. NC State will notify me of any security data breach involving my data as required by applicable law.

Further, I understand that I have the right:

  1. To request access to or transfer my data;
  2. To request information about the methods in which my data is collected and processed;
  3. To request information about the organizations with whom my data may be disclosed;
  4. To request the cancellation or restriction of any data processed unlawfully;
  5. To request corrections to any inaccuracies of my data, and for those corrections to be made if it is deemed inaccurate by NC State;
  6. To object to the collection, retention or use of my personal data if there are compelling legitimate grounds; an
  7. To lodge a complaint with the appropriate authorities, including United States and European Union Governmental Bodies.

I understand that I am not obligated to provide data to NC State; however, if I chose to not provide data to NC State, NC State may be unable to effectively process my application, registration, and enrollment, which may prevent me from being accepted or participating in educational activities.

By clicking consent, I acknowledge that I have read and understand the information in this Agreement, and hereby give my consent for my data to be used in accordance with this Agreement and applicable law. I understand that this consent shall remain in effect for as long as necessary in order for NC State to fulfill the requirements provided herein, unless and until this consent is revoked by me, in writing, and delivered to NC State. However, any such revocation shall not affect disclosures previously made by NC State, or future disclosures made as required by law. I understand this is a legal document which is binding upon me, my heirs, and assigns and on those who may claim by or through me. I am eighteen (18) years of age or older, or my parent or legal guardian has also read, understood and agreed to the terms of this Agreement, and have full capacity to enter into this agreement and do so voluntarily.
